The Department of Environment, Science and Innovation is proposing to make an amendment to a protected area and is seeking views in consideration of the Human Rights Act 2019, including Aboriginal peoples’ and Torres Strait Islander peoples’ cultural rights.

The amendments to be made are as follows:

Tenure Local Government Area Details of proposal
Lawn Hill Resources Reserves (Arthur Creek, Gorge Mouth, Gregory, Gregory River Base, Lilydale, Littles Range, Stockyard Creek, and Widdallion) Mount Isa City

Omit the entirety of the following eight Lawn Hill Resources Reserves:

  • Lawn Hill (Arthur Creek) Resources Reserve
  • Lawn Hill (Gorge Mouth) Resources Reserve
  • Lawn Hill (Gregory) Resources Reserve
  • Lawn Hill (Gregory River Base) Resources Reserve
  • Lawn Hill (Lilydale) Resources Reserve
  • Lawn Hill (Littles Range) Resources Reserve
  • Lawn Hill (Stockyard Creek) Resources Reserve
  • Lawn Hill (Widdallion) Resources Reserve

It is the Department’s view that the above listed Resources Reserves were not validly made as there is no evidence of their previous tenures, a combination of Reserves for Departmental and Official Purposes and Reserves for Department and Official (Natural Resources) Purposes under the Land Act 1962, being revoked. For this reason, dedication of the resources reserves under the Nature Conservation Act in 1994 is invalid.

Comment regarding the proposed amendment to the protected area estate must be in writing and directed to CYPTRPTenure@des.qld.gov.au or the Department of Environment, Science and Innovation, Agreement Making, PO Box 4597, Cairns QLD 4870.

Comments received by 5 August 2024 will be considered by the department.

Amendments to the protected area estate under the Nature Conservation (Protected Areas) Regulation 1994 are administered by the Department of Environment, Science and Innovation.
