Public notice of revocation proposals pursuant to sections 30 and 32 of the Nature Conservation Act 1992
The Department of the Environment, Tourism, Science and Innovation is proposing to make a number of amendments to the forestry and protected area estate. This public notice is pursuant to 173Q of the Nature Conservation Act 1992, and also to seek views in consideration of the Human Rights Act 2019, including Aboriginal peoples’ and Torres Strait Islander peoples’ cultural rights.
The proposals include revocations administered under sections 30 and 32 of the Nature Conservation Act 1992 and dedicating new or amending existing protected areas.
The proposals that revoke parts of the protected area and forestry estates are considered necessary actions that must be taken to promote balanced outcomes for management of the estates or the public interest. The aim of dedicating new or amending existing protected areas is to preserve, to the greatest extent possible, the area’s natural condition, to protect the area’s cultural resources and values and provide for ecologically sustainable activities and ecotourism. The proposals include changing the tenure of a State forest to national park (scientific) to provide stronger protection for threatened species and revoking the entirety of a timber reserve and parts of protected areas for road, freehold access and other purposes.
The amendments proposed to be made are as follows:
| Tenure | Local Government Area | Details of proposal |
|---|---|---|
| Callide Timber Reserve | Banana Shire | Revoke:
The revocation is to allow the area to be granted as freehold to the Gaangalu Nation People, and to facilitate the delivery of Environmental Protection and Biodiversity Conservation Act 1999 (Cth) offsets over part of the land. |

Dedicate:
Upgrading the area to national park (scientific) and the addition of two acquisition properties and an unconstructed closed road will provide the highest level of protection under the Nature Conservation Act 1992 for the new recovery site for the critically endangered northern hairy-nosed wombat. |
| Black Mountain National Park | Cook Shire | Revoke:
The Mulligan Highway and Black Mountain lookout are within the remaining area of the national park and the revocation is to support the realignment of the surveyed road footprint corridor with the constructed road. |

The revocation will support formalising existing access to mining tenements on adjoining unallocated State land. |
